Terms of Service
Effective Date: March 6, 2026
1. Overview
These terms govern all website design, development, and hosting services provided by Pages by David ("we", "us", "the Company") to you ("Client", "you").
By signing up for any plan, you agree to these terms.
2. Plans & Pricing
- Monthly Plan: $0 down, $150/month. Includes a 4-page website, hosting, SEO foundations, unlimited edits, and ongoing support.
- Lump Sum Plan: $4,500 one-time payment. Same deliverables as the Monthly Plan. You own the code outright. Hosting is available as a separate service if needed.
- Starter Plan: $49/month. Single-page website, hosting, and 2 content edits per year.
- Additional pages: $200 one-time per page (Monthly and Lump Sum plans only).
Prices will not change during your contract period. After your contract period, prices are subject to change with 60 days written notice.
Longer contract terms are available and can be negotiated on request.
3. Minimum Commitment & Cancellation
- Monthly & Starter plans: 6-month minimum commitment.
- Early termination fee: $4,500 minus total payments already made. For example, if you cancel at month 3 of the $150/mo plan, you've paid $450. The early termination fee would be $4,050.
- After 6 months: Cancel anytime with 60 days written notice. Email is fine.
- Lump Sum plan: No minimum commitment. You own the code after full payment.
4. Code Ownership
- Lump Sum: You own the website code outright upon full payment.
- Monthly/Starter: Pages by David retains ownership of the website code. You own all your content (text, photos, logos) at all times.
Upon cancellation of a Monthly or Starter plan, we provide all your content (text, images, documents). The site is taken offline. The code is not transferred.
If you want to own the code, the Lump Sum plan is the right choice.
5. Domain Ownership
Your domain is always yours. We will never hold a domain hostage.
If we register a domain on your behalf, it is registered in your name and transferred to you on request at no charge.
You are responsible for domain renewal fees.
6. What Counts as an "Edit"
An edit is a text change, photo swap, hours update, phone/email update, or similar small content change.
An edit is not a new page, new section, redesign, layout change, new functionality, or logo/branding overhaul. These are quoted separately.
- Monthly/Lump Sum plans: Unlimited edits, completed within 1 business day.
- Starter plan: 2 edits per year, completed within 1 business day.
7. SEO: What's Included & What's Not
SEO has two parts: on-page (everything on your website) and off-page (everything outside your website).
Included with all plans (on-page foundations):
- Fast load times and mobile-responsive design
- Accessibility best practices
- Meta tags and descriptions
- Google Search Console submission
- Sitemap generation
- Initial content creation
Not included (ongoing SEO):
- Link building and guest posting
- Local citations and directory submissions
- Content marketing and keyword strategy
SEO is an active, ongoing process that goes beyond what's built into your website. Off-page work is separate from website packages.
Starter plan note: The Starter plan does not include per-service pages or tuned meta descriptions. A single page has limited SEO reach compared to a full multi-page site.

8. What's Not Included
- Logo design or branding
- Professional photography or video production
- Copywriting beyond the initial site build
- Third-party costs: domain registration, Google Workspace, paid advertising, email marketing tools
- E-commerce or payment processing features
- Ongoing SEO services (see above)
- Major structural changes beyond the original scope (quoted separately)
9. Hosting & Uptime
Your site is hosted on Cloudflare, a global infrastructure provider used by millions of websites including Fortune 500 companies. Cloudflare operates data centers in 300+ cities worldwide with built-in DDoS protection, SSL encryption, and a global CDN.
We make every reasonable effort to keep your site online and resolve issues promptly.
We do not guarantee 100% uptime. Brief downtime may occur during updates or due to circumstances beyond our control. Pages by David is not liable for lost revenue or business due to downtime.
10. Payment Terms
- All payments are processed through Stripe. We accept all major credit and debit cards.
- Monthly payments are billed on the same date each month.
- Invoices not paid within 7 days incur a $25 late fee.
- If payment is not received within the 7-day grace period, your site will be taken offline until the balance is resolved.
- All payments are non-refundable.
11. Content & Acceptable Use
You are responsible for the content on your website.
We reserve the right to refuse to publish content that is illegal, defamatory, fraudulent, or otherwise harmful.
We may remove content that violates these terms without prior notice.
12. Portfolio & Testimonial Rights
We may display your website in our portfolio, marketing materials, and case studies unless you opt out in writing.
This includes screenshots, descriptions, and links to your live site.
13. Support Hours
Support requests are handled within 1 business day (Monday through Friday, excluding federal holidays).
We are not available for emergency support outside business hours. If your site goes down overnight or on a weekend, we will address it on the next business day.
14. Changes to These Terms
We may update these terms with 60 days written notice.
Continued use of the service after notice constitutes acceptance.
